Extension of Parental Leave
Resolution of 9 September 2025 of the Spanish Congress of Deputies, ordering publication of the Agreement validating Royal Decree-Law 9/2025, of 29 July, which extends parental leave through amendments to the consolidated text of the Workers’ Statute, approved by Royal Legislative Decree 2/2015 of 23 October; the consolidated text of the Basic Statute of Public Employees, approved by Royal Legislative Decree 5/2015 of 30 October; and the consolidated text of the General Social Security Act, approved by Royal Legislative Decree 8/2015 of 30 October, in order to complete the transposition of Directive (EU) 2019/1158 of the European Parliament and of the Council of 20 June 2019 on work-life balance for parents and carers, repealing Council Directive 2010/18/EU.
The Official State Gazette (BOE) of 11 September 2025 published the Resolution of the Congress of Deputies which, pursuant to Article 86.2 of the Spanish Constitution, validates Royal Decree-Law 9/2025 of 29 July. This Decree-Law extends parental leave and amends Article 48 of the Workers’ Statute (hereinafter ET), Article 49 of the Basic Statute of Public Employees (hereinafter EBEP), and various provisions of the General Social Security Act (hereinafter LGSS), thereby completing the transposition of Directive (EU) 2019/1158.
