The publishing house Lefebvre has just released a new volume in the Claves Prácticas Laborales collection, the result of a collaboration with Sagardoy Abogados that has been ongoing since 2020. Coordinated by  Martín Godino Reyes, Managing Partner of Sagardoy Abogados, and Gemma Fabregat Monfort, Of Counsel at the firm, this monograph is the twenty-first in the series.

The work provides a comprehensive and practical overview of labor subcontracting and includes references to the most relevant case law. It examines Article 42 of the Spanish Workers’ Statute and the legal controversies that have arisen since its introduction in 1980, including the challenges of defining “core business activity” and distinguishing between lawful subcontracting and unlawful labor supply. It also delves into all aspects related to the liability of the principal employer, wage and social security obligations, and occupational risk prevention.

The monograph also addresses the issues arising from the recent amendment to Article 42.6 of the Workers’ Statute and the resulting obligations concerning the provision of information and consultation with workers’ legal representatives.
